Kohnen & Patton’s litigation team recently secured two favorable court rulings in employment discrimination matters on behalf of its clients in federal court. In the first case, which was filed in the U.S. District Court for the Northern District of Ohio in Toledo, Anthony Caruso and Sydney Meyer successfully defended claims asserted against its client by a former employee alleging race discrimination and retaliation in violation of Title VII of the Civil Rights Act, the Family and Medical Leave Act, and Ohio law. They developed evidence in the record and filed a Motion for Summary Judgment on the client’s behalf to establish that the client had not discriminated or retaliated against the employee in any way. The District Court accepted all of the Defendant’s arguments, granted the Motion, and dismissed the case in its entirety.
In the second case Anthony Caruso successfully defended an employer and three of its staff members in the U.S. District Court for the Southern District of Ohio in Cincinnati in an action by two former employees alleging wrongful discharge. The suit alleged 26 separate claims against the Defendants including discrimination, retaliation, whistleblower claims, violation of public policy, and aiding and abetting. After extensive discovery a Motion for Summary Judgment was filed on behalf of all four Defendants seeking dismissal of all claims. Despite strong opposition from the employees’ counsel, the District Court agreed with Defendants’ position and dismissed the case in its entirety.
